You'd absolutely need the rights to make any show that has any ip of the original. Otherwise netflix would be pumping out spinoffs of all the shows that get their most views/subs, but they can't because they only have streaming rights.
Or you could change the characters name and pretend it has nothing to do with american housewife. Instead of oliver and cooper it's benjamin and deacon. Deacon(cooper) calls benjamin(oliver) benny while everyone else calls him ben(no one else can call him benny other than deacon). Ben has 2 unnamed sisters and is often seen on the phone with his mom, who starts yapping, which is when he passes the phone to deacon, who loves to hear her yap. Deacon comes from a very rich family so they live in a really nice place, but deacon has 0 connection to his family as he's an only child and they pay him no attention. Change it from american housewife to american engagement(they're engaged at the beginning of the show) and you got yourself a copyright free spinoff
