To not punish users for posts BEFORE the creator hits a definitive DMCA (including discussion) - it happened before. Users didn't post a single picture, just wrote BEFORE the fact. And then... received points because somehow they didn't have a crystal ball to predict the creator changed their mind and decided to deny even discussions.
