What do y'all think Luigi Mangione's defence will be?

1. Mistaken identity (he is not the shooter despite supposed evidence)
2. Insanity (he honestly could not tell right from wrong despite apparent premeditation and fleeing the scene)
3. Social justice (he believes that the shooting victim deserved it for his perceived wrongs, and he is not sorry for the killing)

No judge would allow a lawyer to run the third defense

It is very likely that they can find 12 people who don't follow the news obsessively to serve
And no, defense lawyers are not allowed to bring up jury nullification

His current lawyer is a commentator on CNN and before she was his attorney said it would likely be an insanity defense because the evidence was so overwhelming.

I believe the other defense could be that he didn't do it - either by an alibi that hasn't been reported or having some of the police investigation disqualified.

I think that Mangione's lawyer will run the first defence (mistaken identity). Mangione is presumably the shooter (likely), but... Maybe he's not the shooter and has nothing to do w/ the shooting (less likely). Or maybe he's not the shooter but is still involved in the shooting (likely). The prosecution's main order will be to prove beyond a reasonable doubt that Mangione is the shooter or was involved in that assassination. If Mangione is caught in a lie, it'll shatter his whole defence and credibility.

There is a possibility that a Mangione look-alike committed the crime, and that Mangione arranged to get caught because he knew he had an alibi that would get him off, and therefore allow the real killer to also get away with it. But then again, why arrange to get caught in the first place if the shooter could just vanish?

As for the second defence (insanity), it'd be a very hard sell, esp. if the suspect doesn't even appear to be remorseful. All the apparent premeditation will not help, and it'll be hard for the jury to believe he was so out of it and regained a conscience shortly after being arrested.

As for the third defence (social justice), bymyname says that no judge would allow it. I see... That's however the argument that Mangione's supporters seem to believe in.
 
The defense is obviously going to be going for jury nullification. It's true the lawyers cannot openly say that's what they want but being a good lawyer is finding ways around excluded evidence or inadmissible hearsay or whatever obstacles are there and getting the message you want to the jury anyway. There are many ways they can highlight the pain Luigi went through without directly saying "and that's why we want you to support jury nullification". They just need a single juror at some point to Google on their own "what do I do if I don't want to vote for a guilty verdict even though they did it". I am not saying this defense will succeed, it depends on the jury and the skill of the lawyers but it's the only valid play that has a chance of him not ending up in jail.

People might think a gay men in prison could have a great time surrounded by lot of sex starved men.

The reality is prisons are dangerous. Most of the inmates are average looking so it is not going be like porn scenario. Most of the sex or a large amount will be coerced or forced. Gay will vulnerable to being raped or exploited.

So hopefully if he is attracted to men Luigi will find someone nice and protective and have some fantastic interludes shall we say.

It is a shame prison isn't like a porno. Some beefy muscular guy takes you under his wing. Dominates the men who want to fucks you and makes them serve you both. He is the boss of the prison wing and so people do what he says so they keep your cell clean and massage your feet and service you in *ahem* all sorts of interesting ways.

Please indulge me and assume Luigi Mangione DOES NOT end up in jail. How does this play out after the justice system is finished with him?

Let's focus on his life after the trail and the public's accessibility to him, if any.
if he is found not guilty there is still a possibility he can be sued by Brian Thompson’s family for wrongful death. One of my friends joked he might become a podcaster but who knows really, he might get overwhelmed by the fame and hide out for a bit also. I know we’re all hoping for an onlyfans ;)
