You've got a strange way of looking at the world my friend. Not everything is measured in legal terms. The world isn't black and white. What a person does or does not do is not a complete picture of who they are. They have thoughts and beliefs that sometimes don't align with their actions. 50 years ago, a gay man wouldn't have been able to openly have a gay relationship, so he'd likely marry and have children, living an unhappy life with a woman he's never been romantically or sexually attracted to. I wasn't trying to argue that Thony is straight, gay or bi. I was merely pointing out that just because a person has sex with someone of the same gender, it doesn't necessarily make them inherently gay or bisexual. Your case isn't a good example, though it is very extreme. Everything is in the details : Yes, Thony would be guilty for DOING gay things, not for BEING gay. Simply like a straight trader would trade gay porn in those countries, though he never sexually touch a guy. Once again, wrong example.
