Yup it’s all subject to interpretation (hence the investigation). You can be charged with trespassing for simply misusing a space you technically have access to (especially if you’ve brought someone with you who doesn’t have access). There are also levels of indecent exposure that don’t require a witness, just a reasonable understanding of the risk of being seen. I also doubt there will be any criminal charges but it all depends who’s pulling the strings and whether or not they care to try and make the case. The law would allow for it.

In addition to the differences in public decency laws from state to state, I think we're also talking about different things... whether charges can be brought (my point) vs. whether prosecution and conviction are possible/likely (your point). Based on the info you provided it sounds like DC has much more lenient indecency laws than NYC. Under NY Penal Law 245.00, both the intent of the perpetrator (did they expose on purpose for sexual gratification?) and the sheer possibility that another person might see the indecency (public space, available lines of sight, etc.) are enough for the city/state to press charges without direct observation.
