I guess the latter case is okay because he had not published the video online. Had he done so without her consent, that would have been a huge and separate issue apart from how the video ended exonerated him from any allegations of pushing her off the balcony. Those are two separate actions.If any of the straight guys find the footage, recognise themself and decide to kick up a stink about it - it would be an interesting test of the new laws because technically its not allowed to film OR post anything unless both people consent to both filming AND posting online but short of dropping trou for the jury to compare his erection to the one in the video im not sure how they could definitively prove it was him in the video beyond reasonable doubt (unless he has identifiable tattoos or freckles or something) but if they manage to there are two charges - one for filming without consent and one for posting without consent and both charges carry a prison sentence of about 10 years each I believe.. Because Australia has such a disgraceful track record with domestic abuse the government came down hard on acts of “revenge porn” where people were posting photos /videos of their ex partner online after they got dumped l. and then of course in a classic Australian move - the laws are worded so they can be misappropriated to cover a ridiculously wide range of situations. So they are now applied to all sorts of situations.
Although a guy on the Gold Coast secretly recorded a tinder hookup he had. She started having a psychosis and destroying his place so he locked her on the balcony. She decided to climb over the edge of the balcony to try to climb down- she slipped, fell and died and witnesses reported looking up and seeing him looking over the balcony after she fell. Luckily he was proven innocent by his “home security footage” which was filmed from multiple angles by multiple hidden cameras! Had he not had the video (which he swears was the “first time he attempted to film a tinder hookup”..) he would 100% be in prison right now for throwing her off the balcony. But because she isn’t alive to complain about being recorded he wont be charged with secretly recording them having sex.
The truth is as much as we enjoy cruising and seduction videos, ones where you’re filming somebody without their knowledge or consent (initially or after-the-fact) and where they have some reasonable expectation of privacy, and then that video gets published, then it starts to feel sketchy once you see the footage and really think about what’s going on.
