Well to be perfectly fair, the shots clearly have the usual porn lens effect as you can see by the perceived dick vs. remote size difference between the two images (as the distance from the camera changes). Even in the supposed front view shot he's angled himself so that he can keep the remote a bit further from the lens. His waist is twisted a bit so his chest is closer to parallel to the lens. based on that ruler it makes him 8 inches because the crease of his base is aligned with the 1 inch mark so that would mean you have to take 1 inch off 9 inches, am I saying he looks 8 inches no, but based on the evidence from this photo he is 1 inch shorter than the controller if we were to align the end of the controller with the crease of his base.

Who cares what his "hanging curved cock" would measure. If we allow this type of horse shit, then where is the line drawn? You have to stick to one specific method of measurement of the entire "thing" falls apart. People have standards, rules, and guidelines for a reason: to keep uniformity.
